General
Cadmus is a vocabulary and learning service operated by Omnisciento LLC (“Omnisciento,” “we,” “us,” and “our”). These Terms of Use (“Terms”) govern your use of the Cadmus mobile application, website, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Service.
Eligibility and accounts
Cadmus is intended for people aged 13 and older. You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use it only with permission from a parent or legal guardian. You are responsible for accurate account information, protecting your credentials, and notifying us at support@cadmusapp.com if you believe your account has been used without authorization. Do not share your account or use another person’s account without permission.
Description of the Service
Cadmus may offer word search, definitions, illustrations, saved words, collections, notes, practice features, and related tools. Features may change, be suspended, or be discontinued when reasonably necessary to improve security, comply with law, or maintain the Service.
The Service is for personal, non-commercial use. It is not professional, medical, legal, educational, or linguistic advice, and we do not guarantee that content is complete, current, or error-free.
Your content
You retain ownership of profile information, collections, learning settings, notes, and other content you submit (“Your Content”). You grant Omnisciento a limited, non-exclusive right to host, process, display, and back up Your Content only as needed to operate, secure, support, and improve the Service.
Do not submit content that is unlawful, infringes another person’s rights, contains malware, or interferes with the Service. You are responsible for Your Content and for having the rights needed to provide it.
Sharing
Cadmus may let you share an image and a link for a selected word and sense. Anyone who receives them may be able to view and redistribute them. You are responsible for deciding whether to share and for using sharing features lawfully. We may revoke or expire links to protect the Service, users, or rights holders.
Cadmus content and acceptable use
The Service, including its design, software, text, editorial content, illustrations, trademarks, and other materials, is owned by Omnisciento or its licensors. Subject to these Terms, we grant you a limited, personal, non-transferable, revocable license to use the Service.
You may not:
- Copy, scrape, reproduce, sell, or distribute Cadmus content except through sharing features we provide, for your personal use, or as otherwise permitted by applicable law.
- Attempt unauthorized access to accounts, systems, or data.
- Interfere with, overload, or disrupt the Service.
- Submit spam, abusive material, harmful code, or unlawful content.
- Use automated means to collect content at scale.
- Reverse engineer the Service except where applicable law permits, or use Cadmus content to train, evaluate, or improve an artificial intelligence or machine-learning model.
We may suspend or terminate access if we reasonably believe these Terms have been violated or suspension is necessary to protect users or the Service.
Feedback
If you send suggestions or other feedback about Cadmus, you grant Omnisciento a perpetual, worldwide, royalty-free right to use that feedback to operate and improve the Service without compensation to you. This does not give us ownership of your private notes, collections, collection-cover images, or other Your Content.
Third-party services
The Service may rely on third parties for app distribution, subscription processing, authentication, cloud infrastructure, analytics, diagnostics, and support-message delivery. Their services are governed by their own terms and privacy notices. Omnisciento is not responsible for third-party services or sites outside our control.
Apple App Store terms
The Apple Standard Licensed Application End User License Agreement (“Apple Standard EULA”) applies to the licence for the Cadmus iOS application unless Apple displays a different applicable licence when you obtain it. These Terms separately govern your Cadmus account and use of the Service. If these Terms conflict with the Apple Standard EULA about the licence to the iOS application, the Apple Standard EULA controls for that licence. You must also comply with applicable Apple Media Services terms when using Cadmus.
Disclaimers and liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMNISCIENTO DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMNISCIENTO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICE. To the maximum extent permitted by applicable law, Omnisciento’s aggregate liability will not exceed the fees you paid for Cadmus during the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot legally be limited.
If you are a consumer, these Terms do not exclude, restrict, or modify statutory rights or remedies that cannot lawfully be excluded, including rights relating to digital content that is not of satisfactory quality, fit for purpose, or as described. The disclaimers and limits above apply only to the extent permitted by the law that applies to you.
Account deletion and changes
You may stop using the Service at any time. You can request account deletion in the Cadmus app’s Profile settings. When deletion completes, we delete your Cadmus account data and associated authentication identity as described in the Privacy Policy. Account deletion does not cancel an Apple subscription.
We may update these Terms as the Service or applicable law changes. If a change is material, we will provide reasonable notice through the Service, by email, or by another lawful method before the change takes effect where required by law. The updated Terms will identify their effective date.
Purchases
Cadmus offers an optional Plus auto-renewable subscription through Apple’s App Store. Plus unlocks the paid features described in the app, including higher or unlimited applicable collection and practice allowances. Before you are charged, Apple presents the applicable price, billing period, renewal terms, and any additional terms. Your subscription renews automatically unless you cancel it through your Apple account settings at least 24 hours before the end of the current billing period. Apple processes payment and manages cancellation, refunds, and billing; purchases are also subject to Apple’s applicable terms and policies.
The price and billing period shown by Apple before purchase form part of your subscription terms. You can manage or cancel renewal in your Apple account settings. Cancellation normally takes effect at the end of the paid billing period unless Apple or applicable law provides otherwise. Deleting your Cadmus account does not by itself cancel an Apple subscription. Nothing in this section limits refund, cancellation, or other consumer rights available under applicable law.
Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, excluding its conflict-of-laws rules. Any dispute must be brought in the state or federal courts located in Essex County, Massachusetts. This choice of law and forum does not deprive you of any mandatory protection or forum available under applicable law.
General terms
These Terms and the Privacy Policy are the entire agreement between you and Omnisciento concerning the Service, except for terms shown by Apple that also apply. If any provision is held invalid or unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of it. Provisions that by their nature should continue after account closure—including ownership, licence restrictions, disclaimers, liability limits, and dispute terms—will survive.
You may not transfer these Terms or your Cadmus account without our consent. Omnisciento may transfer these Terms as part of a merger, reorganization, sale of assets, or other transaction involving the Service, or as permitted by law. Any permitted transfer remains subject to these Terms.
